Terms of Service

Effective: July 2026

These Terms of Service ("Terms") govern your use of the XOOM FOODS website and subscription service operated by Amazica Holdings LLC ("XOOM FOODS," "we," "our," or "us"). By creating an account or placing an order you agree to these Terms.

The Service

XOOM FOODS is a weekly meal-delivery subscription service. Subscribers receive fully cooked restaurant meals, shipped chilled and never frozen, delivered to their door via FedEx. We ship every Tuesday and Thursday via FedEx.

Account & Eligibility

You must be at least 18 years old and a US resident (contiguous 48 states) to subscribe. You are responsible for all activity under your account. Keep your login credentials confidential.

Billing & Renewals

XOOM FOODS is a subscription service billed on a recurring weekly basis. Your payment method on file will be charged automatically on your renewal date. You can view upcoming renewal dates and amounts in the customer portal. By subscribing you authorize XOOM FOODS to charge your payment method on a recurring basis until you cancel.

Pausing & Cancellation

You may pause or cancel your subscription at any time via the customer portal or by emailing info@xoomfoods.com. Cancellation or pause requests must be received before your order enters processing (typically the Friday before your ship day) to take effect for that week's shipment. No partial refunds are issued for the current billing period.

Refunds & Replacements

If your order arrives damaged, with missing items, or in a thawed condition, contact us within 24 hours of delivery at info@xoomfoods.com with photos. We will issue a replacement shipment or account credit at our discretion. We do not issue cash refunds for delivered orders except where required by law.

Acceptable Use

You agree not to misuse the service, including attempting to circumvent our systems, creating fraudulent accounts, or using the service for any unlawful purpose.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. XOOM FOODS DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE SERVICE.

Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, XOOM FOODS'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID IN THE PRECEDING 30 DAYS.

Governing Law

These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers of material changes via email. Your continued use of the service constitutes acceptance of the updated Terms.
